1. Purpose
These rules govern participation, the running of the contest, the scoring mechanics and the delivery of prizes promoted through the RECICLAN application (hereinafter, the "Contest"), organised directly by the local council itself (hereinafter, the "Council" or the "Organising Entity"), as part of its actions to promote recycling and environmental sustainability in the municipality.
The Contest runs with the technical support of the ReciClan mobile/web application (hereinafter, the "Platform" or the "App"), owned by RECICLAN APP, S.L., whose role is strictly limited to the technical aspects described in clause two.
2. Organising entity and nature of the platform
The municipal Council is the organising entity and sole party responsible for the Contest. Accordingly, the Council is exclusively responsible for:
- Setting the conditions of participation, the calendar and the duration of the Contest.
- Determining, assessing and awarding the prizes.
- Physically delivering the prizes to the winners.
- Resolving any incident, claim, query or dispute relating to the points obtained, the ranking or the prizes.
- Complying with the sectoral, tax and administrative regulations applicable to the organisation of contests and the awarding of prizes by a Public Administration.
The Platform acts solely and exclusively as a technological tool or support made available to the Council and the participants, with the following functions:
- Providing visibility and information about the Contest to users.
- Recording and computing the points derived from the recycling actions carried out by each participant, in accordance with the established technical parameters.
- Generating and displaying the ranking of participants based on the points accumulated.
The Platform does not take part in defining the Contest rules, does not participate in decisions on awarding prizes, does not manage or deliver prizes and under no circumstances assumes the role of organiser, promoter or party responsible for the Contest. The legal relationship arising from participation in the Contest exists exclusively between the participant and the Council.
3. Eligibility
The Contest is open to all natural persons who meet the following requirements:
- Being a resident of, or registered as living in, the municipality, unless these rules or their Annex establish a different territorial scope.
- Having a user profile duly registered and validated on the Platform, having previously accepted its Legal Notice, Terms of Use and Privacy Policy.
- Being over 18 years of age. Minors require the express authorisation of their legal representative, under the terms set out in the corresponding Annex.
- Expressly accepting these rules through the procedure provided for that purpose on the Platform.
Council staff directly involved in organising or deciding the Contest, as well as their immediate family members, are excluded from participation in order to guarantee the objectivity and impartiality of the process.
4. Contest mechanics and scoring system
Participation in the Contest consists of the user carrying out recycling actions that can be verified through the Platform, which generate points in accordance with the equivalence table set out in Annex I of these rules.
Points are added up automatically by the Platform based on the usage and recycling data recorded. The resulting ranking is purely informative and indicative of the points accumulated, and does not in itself constitute a definitive award of a prize until the Council's final verification and validation.
The Contest's scoring period will always be announced through the RECICLAN APP.
5. Prizes
The prizes of this Contest, together with their value, number and specific conditions of award, are detailed as determined exclusively by the Council.
Prizes will be delivered by the Council, or by the person or administrative unit it delegates, in the manner, place and time communicated in due course to the winners through the contact channels provided when registering on the Platform.
Under no circumstances may prizes be exchanged for their cash value or transferred to third parties, unless expressly authorised by the Council.
6. Claims, queries and incidents
Any query, incident or claim relating to: (i) the sum or calculation of points derived from recycling; (ii) the position or result in the ranking; or (iii) the award, conditions or delivery of prizes, must be addressed exclusively to the Council.
The Platform is not authorised to resolve claims concerning the substance of the Contest, although it may provide strictly technical information about how the application works and, where appropriate, forward the incident to the Council.
7. Limitation of the platform's liability
In accordance with clause two, liability arising from the organisation, running, resolution and awarding of prizes of the Contest lies exclusively with the Council as organising entity.
The Platform shall not be liable for: (i) decisions taken by the Council regarding points, the ranking or the prizes; (ii) the non-delivery or late delivery of prizes; or (iii) any dispute arising between participants and the Council in connection with the Contest, without prejudice to its responsibility for the correct technical operation of the tool used to record and compute points, as set out in its Terms of Use.
8. Amendment and cancellation of the contest
The Council reserves the right to amend, extend, reduce or cancel the Contest, in whole or in part, where justified reasons of public, technical or organisational interest apply, and must inform participants of this through the Platform and/or the Council's usual communication channels, with due notice where possible.
9. Acceptance of the rules
Participation in the Contest implies full and unreserved acceptance of these rules, as well as of the Council's judgement in resolving any matter not provided for in them. These rules will be available to participants on the Platform and/or on the Council's electronic office throughout the period of the Contest.
10. Applicable law and jurisdiction
These rules are governed by Spanish law and, in particular, by the regulations governing the legal regime of Public Administrations, without prejudice to the application of the data protection and information society services regulations that may apply.
Any dispute arising from the interpretation or application of these rules that cannot be resolved through administrative channels shall be submitted to the competent contentious-administrative courts, the parties expressly waiving any other jurisdiction to which they may be entitled.
